Terms of Sale

Article 1 – Definitions

These Terms of Sale (the "Terms") are offered by AD EVOLIS, a French company registered with the Compiègne Trade and Companies Register under number 106 996 606 (the "Company").

In these Terms:

  • "Website" means the website https://blossaglow.com and all of its pages, owned exclusively by the Company.
  • "Products" means all the products that can be purchased on the Website.
  • "Seller" means Blossaglow, operated by the Company, which offers its Products on the Website.
  • "Customer" means any person, individual or business, who purchases Products on the Website.
  • "Consumer" means any individual acting for purposes outside their trade, business, craft or profession.

Visitors interested in the Products are invited to read these Terms carefully and to print and/or save them on a durable medium before placing an order. The Customer acknowledges having read these Terms and accepts them in full.

Article 2 – Scope of the Terms and purpose of the Website

The Seller may modify these Terms at any time by publishing a new version on the Website. The Terms applicable to the Customer are those in force on the date of their order.

Legal information about the host and publisher of the Website, the collection and processing of personal data and the conditions of use of the Website are provided in the Legal Notice, the Privacy Policy and the Terms of Service.

The Website sells beauty and wellness products for women online.

Access to the Website is free. Purchasing a Product implies the Customer's full acceptance of these Terms. By ticking the box accepting these Terms, or by completing their order, the Customer confirms that they have read and accepted them.

By accepting these Terms, Customers confirm that they have the legal capacity to do so. If the Customer is a minor or lacks legal capacity, they declare that they have the permission of a guardian or legal representative.

The Customer acknowledges the evidential value of the Seller's automatic recording systems and, unless they can prove otherwise, waives the right to contest them in the event of a dispute.

Any order of Products implies the Customer's unreserved acceptance of these Terms, which prevail over any other document such as catalogues, advertisements or leaflets, unless expressly agreed otherwise in advance by the Company.

Article 3 – Customer service

Customer service can be reached by email at contact@blossaglow.com, or by post at the address given in the Legal Notice. The Customer must include their first name, last name, the subject of their request and their order number.

Business enquiries (partnerships, media, contract proposals) can only be sent by email to contact@blossaglow.com.

Article 4 – How to order

The Products offered are those listed in the catalogue published on the Website. Each Product is accompanied by a description written by the Seller based on the information provided by the supplier.

Photos on the Website are not contractual and may differ slightly from the actual Products, due in particular to screen and camera settings, lighting and shooting angles.

The "Cart" is the virtual basket containing all the Products selected by the Customer. The Customer can change its contents at any time before ordering.

  1. The Customer selects one or more Products from the catalogue by clicking "Add to cart". On the cart page, the Customer can check the details of their order and correct any errors before confirming it.
  2. At checkout, the Customer enters their contact details and shipping address and chooses from the shipping methods offered.
  3. The Customer enters their payment details and billing address, and may enter a discount code if they have one.
  4. A full order summary is displayed. The Customer can change any element of the order before completing it and is responsible for any errors in the order, Products and contact details.
  5. The sale is concluded when the Customer confirms the order by clicking the final payment button, has accepted these Terms and has paid, subject to the right of withdrawal.

The order is validated on the date the full payment of the price, including taxes, is received.

Article 5 – Prices and payment

Unless otherwise stated, prices in the catalogue are shown in the currency displayed at checkout, including taxes where required by the law of the delivery country, and excluding any processing and shipping costs.

The Seller may change its prices at any time. However, the price shown in the catalogue on the day of the order is the only price applicable to the Customer.

The Customer can pay by credit or debit card and by the other payment methods offered at checkout. Card payments are made through secure transactions provided by an online payment platform.

The Website has no access to the Customer's payment details. Payment is made directly to the bank or payment provider receiving the Customer's payment. Product availability is shown on each Product page.

The Seller keeps order forms and invoices on a reliable and durable medium. Computerised records will be considered by the parties as proof of the communications, orders, payments and transactions between them.

Article 6 – Delivery

Shipping costs are shown to the Customer before payment. The Website delivers to the countries offered at checkout: the United States, the United Kingdom, Canada, Australia and New Zealand. Orders are delivered within an estimated seven (7) to eight (8) business days from the date of order, including preparation and engraving time. These delivery times are estimates and may be affected by postal service delays or other circumstances preventing delivery (strikes, bad weather, etc.).

For deliveries outside the European Union, the Customer is the importer of the Products. Import duties, taxes and customs fees may be charged by the destination country, and the Seller may be unable to provide the exact amount of these charges in advance.

Unless otherwise stated during the ordering process or in the Product description, the Seller undertakes to deliver the Products to a Consumer within a maximum of thirty (30) days after the conclusion of the contract.

If the Customer notices a problem at delivery (damage, missing Product, damaged parcel, broken Products), they may refuse the parcel and must note the problem on the delivery slip in the presence of the carrier. For mailbox deliveries, the Customer agrees to check the parcel immediately and to contact Blossaglow customer service if they notice any problem.

If a parcel is returned to the Seller by the carrier, the Seller will contact the Customer to ask how to proceed with the order. If the Customer refused the parcel by mistake, they may request reshipment after paying the new shipping costs, even if shipping was originally free.

In the event of a delivery error or an exchange, any Product to be exchanged or refunded must be returned to the Seller complete and in perfect condition. Defects resulting from misuse by the Customer cannot be attributed to the Seller.

If delivery is later than the date or period indicated to the Consumer at the time of order, or, if no date was given, more than thirty (30) days after the contract was concluded, the Consumer may cancel the sale by written notice after having asked the Seller to deliver within a reasonable additional period without result. The Consumer will then be refunded all sums paid no later than fourteen (14) days after the contract is terminated. This clause does not apply if the delay is due to force majeure.

If a tracking number shows a parcel as "delivered" but the Customer has not received it, customer service may ask for additional information and for an official response from the carrier regarding the tracking number. The Seller will then do everything possible to satisfy the Customer, in particular by offering to reship the Products at its own expense.

Article 7 – Right of withdrawal and returns

Under Articles L.221-18 et seq. of the French Consumer Code, the Consumer has fourteen (14) days from receipt of their order to withdraw from the contract without giving any reason. As a commercial gesture, Blossaglow extends this period to thirty (30) days from delivery, as described in our Refund Policy.

To exercise this right, the Consumer must notify Blossaglow by email at contact@blossaglow.com, using the withdrawal form below or any other unequivocal statement. The Product must be returned complete, in perfect condition, unused and in its original packaging. Return shipping costs are borne by the Customer.

Under Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to sealed goods that cannot be returned for health protection or hygiene reasons once they have been unsealed after delivery.

We recommend that the Customer uses a trackable shipping service for returns. Otherwise, if the returned parcel does not reach the Seller, it will not be possible to open an investigation with the carrier.

The refund will be made within fourteen (14) days using the same payment method as the original transaction, unless the Customer expressly agrees to another method, and at no cost to the Customer. The Seller may withhold the refund until it has received the Product or until the Customer has provided proof of shipment, whichever comes first.

The Customer may be held liable for any depreciation of the Products resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning.

Withdrawal form (complete and return this form only if you wish to withdraw from the contract):

  • I/We hereby give notice that I/we withdraw from the contract for the sale of the following goods:

  • Email address:
  • Postal address:
  • Request: exchange (state the product wanted) or refund (made to the payment method used for the order)
  • Signature (only if this form is sent on paper):
  • Date:

Article 8 – Legal guarantees

All Products purchased on the Website benefit from the following legal guarantees, independently of any commercial guarantee:

  • Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code): the Seller must deliver goods that conform to the contract and is liable for any lack of conformity that appears within two (2) years of delivery. In the event of a lack of conformity, the Consumer may choose between repair and replacement of the goods, unless the chosen option would entail a manifestly disproportionate cost compared with the other.
  • Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the Consumer may act within two (2) years of discovering the defect and may choose between cancelling the sale and a reduction of the price (Article 1644 of the Civil Code).

In the event of a non-conforming Product, it may be returned to the Seller for exchange. If an exchange is impossible (obsolete Product, out of stock, etc.), the Customer will be refunded on the payment method used. In this case, the costs of the exchange or refund, including return shipping, are borne by the Seller.

Article 9 – Liability

The Seller cannot be held liable for failure to perform the contract due to force majeure. For Products purchased, the Seller shall not be liable for any indirect damage, loss of business, loss of profit or costs that may arise.

The choice and purchase of a Product are the sole responsibility of the Customer. The total or partial inability to use the Products, in particular due to incompatibility, cannot give rise to any compensation, refund or liability of the Seller, except in the case of a proven hidden defect, lack of conformity, defect, or exercise of the right of withdrawal.

The Customer uses the Website at their own risk. Blossaglow cannot be held liable for:

  • any direct or indirect damage, including loss of profits, customers or data, resulting from the use of the Website or the inability to use it;
  • any malfunction, unavailability, misuse or misconfiguration of the Customer's device, or the use of an uncommon browser;
  • the content of advertisements and other external links or sources accessible from the Website.

Nothing in these Terms limits the Seller's liability where such limitation is prohibited by applicable law.

Article 10 – Force majeure

Under Article 1218 of the French Civil Code, force majeure means events beyond the control of the parties, which they could not reasonably foresee, avoid or overcome, and which make the performance of their obligations impossible.

Force majeure automatically suspends the performance of the order. If the force majeure continues for more than ninety (90) calendar days, either party may cancel the order and terminate the contract by written notice. In this case, neither party may claim damages, unless otherwise agreed by both parties.

Article 11 – Intellectual property

All elements of the Website belong to the Seller or to a third party, or are used by the Seller with the permission of their owners.

All texts, comments, illustrations and images reproduced on the Website are protected by copyright, trademark and image rights. No one may reproduce, exploit, redistribute or use any element of the Website, even partially, for any purpose, without the Company's express written consent. Only private use of the Website is authorised.

Any reproduction of the Company's catalogue is strictly prohibited and constitutes infringement. Trademarks and logos on the Website may be registered by Blossaglow or its partners. Anyone who reproduces or distributes them is liable to the penalties provided for in Articles L.713-2 et seq. of the French Intellectual Property Code.

Article 12 – Personal data

The Company collects Customer data in order to process and follow up orders, to contact Customers about the Company's news, Product updates and customer relations, and to improve the Website and its Products, in particular through cookies.

The data collected is processed by the Website's contractual service providers in charge of packaging and delivering the Products, and by its hosting provider, Shopify International Limited, whose servers are secured and protected by a firewall.

The data is kept only for as long as necessary for these purposes and in any case for no longer than five (5) years.

In accordance with Regulation (EU) 2016/679 (GDPR) and French data protection law, the Customer has the right to access, rectify, erase and object to the processing of their data. The Customer can exercise these rights by email at contact@blossaglow.com. More details are available in our Privacy Policy.

Article 13 – Customer comments and submissions

If the Customer sends ideas, suggestions or other material, online, by email, by post or otherwise ("comments"), whether or not at the Company's request, the Customer grants the Company the right, at any time and without restriction, to edit, copy, publish, distribute, translate and otherwise use these comments in any medium.

The Company is under no obligation to keep comments confidential, to pay compensation for any comment, or to respond to comments.

The Company may monitor, edit or remove content that it determines, in its sole discretion, to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes any intellectual property or these Terms.

The Customer agrees that their comments will not violate any third-party right, including copyright, trademark, privacy or personality rights, will not contain unlawful, defamatory, offensive or obscene material, and will not contain any computer virus or malware. The Customer agrees not to use a false email address, impersonate anyone, or mislead the Company or third parties about the origin of their comments. The Customer is solely responsible for their comments and their accuracy.

Article 14 – Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, directors, agents, contractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Website or our Products, your breach of these Terms, or your violation of any law or the rights of a third party.

Article 15 – Severability and entire agreement

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, nor release the Customer from their contractual obligations.

These Terms replace all prior or contemporaneous agreements, written or oral. They may not be assigned or transferred by the Customer. These Terms are written in English, and all correspondence relating to them shall be in English.

Article 16 – Governing law and disputes

These Terms are governed by French law.

In the event of a dispute, the Customer is invited to first contact customer service at contact@blossaglow.com in order to find an amicable solution.

Failing an amicable solution, the dispute shall be submitted to the competent French courts, without prejudice to the mandatory consumer protection provisions of the Consumer's country of residence.

The Website reserves the right to take legal action against any attempted fraudulent purchase, including the use of a stolen, blocked or counterfeit payment card.
